GENERAL SALES CONDITIONS
www.fournapolitain.com is a website aimed exclusively at
professionals for the purchase of products for their
professional activity. That is why prices excluding tax are
highlighted.
The sales conditions define the
contractual relationship between the seller and the buyer.
These conditions apply to any purchase made on the seller's
online store. Just as in the seller's offices or remotely
without going directly through the website. Any order on the
website, in-store, or remotely implies consultation and
acceptance of these general sales conditions. Validation of
the order implies acceptance of these sales conditions and
recognition of having fully read them. Validation of a quote
or purchase order is considered as a signature and acceptance
of the sales conditions.
ONLINE ORDERING
Any order placed on the website www.fournapolitain.com will be subject to a confirmation email sent to the address provided by the buyer. The order will be processed upon receipt of payment. Availability and shipping times start from the receipt of payment.
PRODUCTS
The products presented on the website www.fournapolitain.com are available within the limit of the stocks offered by our suppliers. Product photos are for illustrative purposes only. Product descriptions and technical details are not part of the contractual terms and, in no case, will the seller be held responsible for any errors.
PRIX
The prices of the products are not displayed on the website
www.fournapolitain.com. To know the prices of the products,
you will have to request a quote. The price in effect on the
day of the order will serve as the basis for invoicing. All
prices are indicated in euros and are net of taxes. The
applicable VAT rate is 20%. (For European Union countries with
a VAT number, the price to be paid will be without VAT.)
Even
if the packaging appears to be in good condition, it is
imperative to open all packages to check the product.
Similarly, for an order of several items, please verify the
number of packages before signing the carrier's delivery note.
The products are delivered to the commercial address indicated
by the buyer on their order form. The products are delivered
in metropolitan France (excluding Corsica). For any orders
destined for Corsica, Overseas Territories and Export,
shipping costs will be established after a quote from the
carrier and will be communicated to the buyer. The same
applies to ski resorts or mountain restaurants. It is up to
you to let us know so that we can check with our carriers. You
are required to inform us if your location is in a
difficult-to-access area.
Please note that delivery
does not include installation or commissioning of the product.
Delivery is understood to be at the back of the truck. The
handling of the equipment after unloading remains the
responsibility of the customer. The carrier is not obliged to
bring the equipment into your establishment. Additionally,
please note that if there are steps to access your store, your
packages will be left at the bottom of the steps. Similarly,
if you are on a higher floor or in a shopping mall without
external access, the carrier will leave the equipment as close
as possible to the entrance.
PAYMENT METHODS
To place an order, we require a quote with your "approval", stamped and signed. We also require a 20% deposit of the total order amount. Upon receipt of the deposit payment, we will send you the invoice. The invoice must be paid in full before the equipment is dispatched. Payments will be made exclusively by bank transfer.
DELIVERY TIMEFRAME
Delivery times are given as an indication. We advise you to
contact us for a more precise date before placing your order.
Indeed, some items may be available within shorter lead times
than those indicated.
Under no circumstances can
delivery delays give rise to or motivate a claim for damages
or cancellation of an order.
SHIPPING - TRANSPORTATION
Goods always travel at the customer's risk. All equipment
leaving our collaborating factories is insured. In any case,
it is the customer's responsibility to check the condition of
the equipment received (open the package imperatively) and to
exercise their recourse against the carrier by noting any
damages to the equipment on the delivery note and, if
necessary, refusing the equipment that you consider unusable.
Confirm the damages by registered letter to the carrier within
48 hours (Art.105 Commercial Code) under penalty of
foreclosure. If you accept the equipment without opening the
packaging and subsequently discover any damage, there can be
no recourse. The words "subject to unpacking" or "box in good
condition" eliminate the carrier's liability and remove any
recourse.
Even if the packaging appears to be in
good condition, it is imperative to open all packages to check
the product.
Similarly, for an order with multiple
items, please verify the number of packages before signing the
carrier's delivery note.
Products are delivered to
the commercial address indicated by the buyer on their order
form. Products are delivered in mainland France (excluding
Corsica). For any order to Corsica, French overseas
territories, or for export, shipping costs will be established
after the carrier's estimate and communicated to the buyer.
The same applies for ski resorts or mountain restaurants.
Please notify us so that we can check with our carriers.
Please
note that delivery does not include installation or
commissioning of the product. Delivery is to the tailgate of
the truck. The handling of the equipment, after unloading,
remains the responsibility of the customer. The carrier is not
obligated to deliver the equipment to your establishment.
Additionally, please note that if there are stairs to access
your store, your packages will be left at the bottom of the
stairs. Similarly, if you are on a floor or in a shopping
gallery without access from the outside, the carrier will
deliver the equipment as close as possible to where they can
access it with their pallet truck.
During shipment,
it is important to distinguish between your supplier and the
carrier who is a service provider.
RIGHT OF WITHDRAWAL
In a sale between professionals, that is, a sale made for the needs of a professional activity, the buyer does not have any right of withdrawal.
PRODUCT WARRANTY
The warranty for the products sold on the website
www.fournapolitain.com is provided for 1 year by their
manufacturers, and we add an additional 1-year warranty on
spare parts for all pizza ovens. The equipment must be
installed by a professional. The seller declines all
responsibility in case of incorrect connection or
installation. An installation invoice may be requested. It is
your responsibility to keep the installation invoice made by a
professional for the entire warranty period.
The
warranty is limited to the replacement of recognized defective
parts (excluding wear parts, glass, hinges, seals, bulbs,
marble, refractory stone, quartz tube...). The manufacturer
may ask you to return the defective part for analysis of the
cause of the failure. In case of lightning, we advise you to
contact your insurance. A breakdown can in no case lead to the
exchange of the equipment or any damages and interests. The
labor related to the replacement of these parts and their
transportation are the responsibility of the buyer. The
warranty takes effect on the date of invoicing.
RETURN OF SPARE PARTS
The breakdown must be diagnosed by a professional in order to precisely identify the part to be replaced. The part must be sent to us at the buyer's expense. The replacement of the part will be taken into account upon receipt of the defective parts and after verification by the technical department. The part must be accompanied by the service technician's after-sales service form.
JURISDICTION
For any dispute, regardless of its nature or cause, jurisdiction is assigned to the Commercial Court of Tarascon, regardless of the place of delivery. Any order automatically implies the buyer's agreement to these general terms and conditions of sale.
